Employment documents - Why you need a lawyer

Financial Assets

Helping you properly document employment relationships with staff

Documenting employment relationships with your workers is an essential part of managing your workplace relations obligations. It is not always easy for employers to properly document employment relationships with staff. There are many legal obligations that must be followed. A lawyer can help you properly document these relationships in line with the legal requirements.

Timely Legal Services

Ensuring you understand your responsibilities and obligations

If you are unaware of your responsibilities or obligations as an employer, it is important to seek legal advice. Your business may be at risk of significant financial recourse from not meeting your lawful obligations in full. We can help you understand what is required of you under employment law.

Dispute Resolution

Assisting you in making adjustments to your employment documents

It is important to ensure all of your employment documents remain accurate and up to date. We can help you make changes to your employment documents to reflect any changes in the workplace such as any new company policies introduced into your workplace that your employees must be aware of.

Frequently asked questions

Employees will need to be provided with a range of documentation to confirm the nature of their role, the terms of employment and guidance as to the employer’s expectations. Employment documents can also include:

- Fair Work Information Statement (Fair Work Act requirement);
- A copy of their employment agreement;
- The description of their position;
- A tax file number declaration form;
- A choice of superannuation fund form; and
- Other relevant workplace policies and procedures.
If you wish to terminate an employee, it is a legal requirement that you provide a letter of termination that has the date of termination included. You should also consult your employee and let them know what entitlements they can receive and the reason they are being terminated from the job.
If you have noticed issues in your workplace, it is important to consider what the issue is and if you have a company policy that relates to the issue. You may present your employees with a letter addressing your concerns, but this is not required. You could also have group meetings or one on one meetings to discuss the issue.
There are many obligations employers must comply with when dealing with employment documents. Failing to properly document such matters can result in a range of adverse outcomes for employers such as putting the business at risk of significant financial recourse.
If you have just been offered a job and you have accepted that offer, your employer will ask you to complete a tax declaration form and give them some details for your employee records. These details usually include:

- Your full name;
- Your address;
- Your phone number;
- Your emergency contacts;
- Your superannuation fund details;
- Your tax file number;
- Your banking details;
- Your date of birth if you are younger than 21; and
- Your parent or guardian’s details if you are younger than 18.
